In concession


Since many people don't know what that means and you can read it in many real estate offers, here is a brief explanation. However, we recommend explaining the process and all related questions in a personal conversation.


A concession simply means that you lease the land (plot/finca) from the municipality. The lease is usually for 30 years and can then be extended without any problems. In terms of construction and housing law, there is no difference to ownership. If you want to use the finca commercially, this is not possible except for agricultural purposes.


The purchase of the finca does not go through the notary but through the municipality.


A concession also has some advantages, e.g. no notary fees, no inheritance tax, and it cannot be seized.

Illegally built fincas


We are also often asked about the illegal construction of houses or wells. Most houses are legal or have been legalized retrospectively. It does happen from time to time, even if it is rare, that we record a house and offer it for sale, despite repeated inquiries as to whether all the paperwork is in order. But don't worry, we will have our lawyer carefully check all the paperwork again before the sale. If this does happen, it does not immediately mean that you cannot buy the property. We will check and apply for subsequent legalization with the seller and our architect. The fees and all costs incurred will then be deducted from the purchase price and recorded by the notary.

The situation with the well is somewhat different. We know what is written on the Internet, including about the water shortage. Please don't let it drive you crazy, in some regions things really aren't looking good, the water is regularly turned off overnight there, but not here. Here in the region around Almonte we still have enough. There are three types of well here. 1. the century well, 2. the legal well and 3. the illegal well. The century well does not require a permit, the legal well naturally has all the documentation and on some fincas even a water meter and a well log. This is how the water extraction is controlled. And the 3rd is tolerated, here in the region we have, to put it cautiously, 60 - 70% of the 3rd type. If you have any further questions, do not hesitate to ask us.
